A new fund, aimed at promoting Dubai as a global hub for financial technology (FinTech), has been approved by His Highness Sheikh Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai and Chairman of the Executive Council.

The AED370 million ‘Venture Capital Fund for Start Ups’ will finance small to medium projects, supporting their development in Dubai and gradual expansion to global markets.

Announced following yesterday’s meeting of the Executive Council, it will be managed by the Dubai International Financial Centre, which is also a 15% contributor, and will create an integrated funding system with a number of suitable options that can cater to the needs of enterprises. 

The Fund is set to bolster Dubai’s GDP by around AED3 billion during the implementation period, which will run for eight years, extendable for two additional years.

It will also provide more than 8,000 jobs for emerging talents, thus strengthening Dubai’s position as a regional centre for entrepreneurship and FinTech, innovation and venture capital, and ensuring that it attracts investors and entrepreneurs from around the world.

The Fund will come into effect starting June 2022.

The Department of Economy and Tourism (DET) in Dubai has issued its first-quarter 2022 report on the business environment. The report developed by the DET’s Business Registration and Licensing (BRL) sector shows that 24,662 new business licenses were issued in Q1 2022, a growth of 58% from Q1 2021, when 15,580 licenses were issued.

The exceptional growth underlines the robust fundamentals, resilience, and sustainability of Dubai’s economy, led by a progressive vision and a strong ability to withstand challenges and maintain a healthy growth rate. The substantial rise in new business licenses also highlights the confidence of investors and businesses in Dubai’s growth potential across various sectors.

Furthermore, the figures demonstrate DET’s continuous efforts to achieve the vision and directives of His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE and Ruler of Dubai, to support productivity, growth, economic diversification, sustainability and competitiveness in the emirate, as well as build strategic economic sectors and provide high-quality services that meet the highest international standards.

According to the report, 57% of the new business licenses issued during Q1 2022 were professional and 43% were commercial. Bur Dubai accounted for the largest share (16,577) of the new licenses issued, followed by Deira (8,066) and Hatta (19), while the top sub-regions were: Al Fahidi, Al Marrar, Burj Khalifa, Dubai Investment Park 1, Port Saeed, Al Quoz 3, Naif, Trade Centre 1, Hor Al Anz East and Al Barsha 1.

Among the legal forms of the new licenses issued, Sole Establishment companies topped the list with 33%, followed by Civil Companies with 26% and Limited Liability Companies with 19%. The legal forms also included: One-Person Limited Liability Companies, Branches of companies based in other emirates, Branches of Foreign Companies, Branches of Free Zone Companies, Branches of GCC Companies, and Public Shareholding Companies.

A total of 136,034 business registration and licensing transactions were completed during Q1 2022, a growth of 36% compared to Q1 2021 when total transactions reached 99,741. The number of Initial Approvals reached 19,835, a growth of 43% compared to the same period last year (13,914), while Trade Name Reservations reached 22,112, a growth of 29% compared to Q1 2021 (17,133).

The BRL sector reported that 7,492 Instant Licences were issued during Q1 2022, a growth of 310% compared to Q1 2021, during which 1,828 licenses were issued. The instant license service provides a convenient and easy solution for businessmen to obtain a commercial license within five minutes on the Invest in Dubai platform – invest.dubai.ae – to establish and conduct business in Dubai. Businesses can secure their business license in one step without having a company lease or location for the first year.

The DET highlighted the importance of close collaboration between the government and private sectors to support economic development and the ambitious vision of Dubai and the UAE. The DET strives to deliver solutions that contribute to facilitating growth and ease of doing business in Dubai.

Lady Elizabeth Kelly says that, “Empowerment is a perplexing method that entails numerous facets such as increased recognition, enhanced dissemination of information, social, economic, and political resources, and amelioration of self-image.

Lady Elizabeth Kelly states that, “If more women are to be transformational leaders, they must have equal access to and attainment of educational qualifications. Women’s literacy is critical in improving family health, nutrition, and education, as well as empowering women to participate in societal decision-making.”

Governments should take steps to promote the proper development of girls’ and women’s potential through education, skill development, and the abolition of illiteracy for all girls and women without discrimination, with a focus on the abolition of poverty and ill health. Governments, in collaboration with civil society, should take the necessary steps to ensure universal access to appropriate, affordable, and high-quality health care for women throughout their lives, based on gender equality.

Lady Elizabeth Kelly emphasises that acquiescence in empowering any aspect of society can be viewed as a means of creating an environment in which one can make decisions and choices for social transformation, either individually or collectively. She claims that empowerment strengthens ability by acquiring knowledge, power, and experience, as it is a method of authorising an individual and allowing him to think and act more emphatically. In simpler terms, it aids in gaining control over one’s own life and destiny.

The need for empowering women was felt when society began to underestimate women and the position that was supposed to be given to them was, in fact, not given to them. The main reason for empowerment has a very fundamental reason behind it, which is the growing trend of underestimating women to the point of making them occupy a secondary position in society and failing to provide them with their basic rights.

Further she elaborates that, “Power dynamics that obstruct women’s pursuit of healthy and fulfilling lives exist at many levels of society, from the most personal to the most public. Lady Elizabeth Kelly highlights that, gender stereotypes encourage us to expect emotional, collaborative women and logical, directive males, which exacerbates the presumption-of-competence effect. When males talk from the heart or manage collaboratively, it is interpreted as evidence of range, which is a positive. Women’s emotional communication or inclusive approach, on the other hand, is implicitly perceived as proof of incompetence or refusal to do otherwise, even when the circumstance demands it.

Consumer habits have forced brands to prioritize digital and adjust budgets, which has dramatically increased the role influencers play in a brand’s overall strategies.

Influencer marketing has exploded over the past several years with the rise of social media stars. It should be no surprise that the influencer marketing space is expected to grow from just over $13 billion to at least $15 billion by 2022.

With the increasing trend in social media marketing and the rising number of Social media influencers, the authorities have taken necessary steps in order to ensure compliances into the industry.

Federal Tax Authority is one of such authorities that has invested time in ensuring tax applicability on SMIs.

Social media influencers and artists in the UAE must pay value-added tax (VAT) on the services they provide, the UAE’s Federal Tax Authority (FTA) has confirmed.

In a bulletin issued by the FTA, services included any online promotional activities, such as a blog or social media posts, paid physical appearances, or any marketing activities.

The authority also said that if the artist or influencer recovered costs from their client then these would also be subject to VAT. All artists and influencers are required to register for VAT if the value of the services they provide exceeds AED375,000 ($102,100) in a 12-month period.

In addition, the FTA pointed out that if social media influencers or artists received goods – such as mobile phones or other gifts – in return for their services, instead of cash, then these too must be accounted for in their VAT calculations. VAT was introduced in the UAE on Jan. 1, 2018, at a rate of 5 percent.

To summarise the key takeaways from the bulletin are given below.

  • Supplies made by Artists and SMIs will follow the general rule of VAT and will be subject to VAT at the appropriate rate of either 5% or 0% (subject to meeting the zero-rate conditions).
  • The recharge of costs incurred by SMIs or Artists in rendering the services will also fall within the scope of VAT.
  • As a general rule, tax invoices or simplified tax invoices must be issued for any taxable supplies made by Artists and SMIs.
  • All UAE based Artists and SMIs will need to assess their VAT registration liability according to the normal VAT registration rules, which require a business to register for VAT if the value of taxable supplies and imports in the last 12 months exceeded AED 375,000, or if is anticipated the AED 375,000 threshold will be exceeded in the next 30 days.
  • Non-resident Artists and SMIs who make any taxable supplies in UAE are also required to register for VAT if there is no other person (i.e. a VAT registered recipient of the supply in the UAE) who is obligated to account for VAT on the supplies on a reverse charge basis.
  • There is no registration threshold for non-resident businesses so any taxable supplies made to a non-VAT registered recipient in the UAE will create a VAT liability for a non-resident Artist or SMI.
  • The FTA has confirmed that for the purpose of calculating the threshold, the SMIs or Artist should take into account all taxable supplies they make, even if they do not fall under the core artistic or influencer activities.
  • Where an Artist or SMI enters into barter arrangements, for instance, receiving goods in exchange for providing services, the goods will be treated as consideration for the service and VAT must be accounted for on the value of this consideration. The VAT legislation provides that where all or part of the consideration for a supply is non-monetary, the value will be calculated as a sum of the monetary part and the market value of the non-monetary part, less the VAT amount.
  • Where the Artists and SMIs provide services for free, the transaction needs to be assessed under the deemed supply provisions and treated accordingly.
  • As a general rule of input VAT recovery, Artists and SMIs will be eligible to recover the input VAT incurred fully subject to the normal restrictions under the UAE VAT law – such as entertainment services, and the purchase, lease or rental of motor vehicles that are available for personal use.

The bulletin has addressed specific scenarios of the industry such as:

  • Where the Artists/SMIs own an event management company, then supplies made by the individuals will be considered as distinct from the supplies made by the company. Therefore, VAT obligations will be required to be met separately.
  • Where intermediaries act as agents on behalf of, and in the name of, Artists or SMIs, output VAT will need to be accounted for by such intermediaries on their commission. Artists and SMIs will then need to account for VAT on the entire consideration charged to their clients.
  • Where intermediaries act in their own name and contract with both the client and the Artists or SMIs separately, VAT will need to be accounted for on the full amount charged by the SMI or Artist to the intermediary and the intermediary will account for VAT on the full amount charged to the client.
  • Where an UAE resident Artist or SMI is engaged by a UAE based client to provide advertising services outside of UAE, the supplies will be subject to the standard rate of 5%. For instance, the UAE-based client owns a resort overseas and contracts with a UAE SMI to promote the resort by vlogging their experiences in the resort or posting stories on social media platforms, the supplies made by the UAE resident SMI will be subject to VAT at 5%.
